How Estate Planning Can Mitigate the Risk of Litigation Over Digital Assets

The rise of digital assets – such as cryptocurrencies, NFT’s, and online accounts has created new complexities in estate administration. Unlike tangible property, digital assets often lack clear ownership. As a result, disputes frequently arise and ownership becomes contested between beneficiaries.

What is Estate Planning?

Estate planning is the process of arranging how a person's assets, responsibilities, and legal affairs will be managed if they lose capacity or in the event one passes away. It usually involves planning the distribution of assets, management of estate, and other instructions.

Comprehensive estate planning can significantly mitigate the risk of legal entanglements that may arise.

Mitigation of Risk of Litigation over Digital Assets

1. Clarifying Ownership and Access

Clarifying which Digital assets including social media, online accounts etc. form part of the estate. Clarity of ownership reduces dispute of whether the deceased had true ownership of the asset, transferable rights, or merely a license. Ultimately, this will ensure executors can lawfully access estates, without the rise of conflict with other parties.

2. Reducing Ambiguity about Intent

A will or digital asset memorandum will typically expressly set out the deceased’s intention: such as who will inherit such assets, or the duties of trustees. By demonstrating clear intentions within a will, greater ease will be provided in determining who is entitled to what assets.

3. Reducing Conflict Between Beneficiaries

Digital assets may carry sentimental or economic value. The explicit allocation of assets reduces disputes between beneficiaries including competing claims as who is rightfully entitled, is made clear.

4. Ensuring Legal Compliance

Adequate legal planning of estates authorises access and avoids executors unintentionally breaching privacy, contract, cybercrime, or other will related obligations. Therefore, reducing the likelihood of other parties taking legal action.
